Description

Contractual (Non-AST) Tenancy Agreements – Residential Letting Where ASTs Do Not Apply (England)
Designed for Lettings Excluded from the Assured Shorthold Tenancy Regime

While Assured Shorthold Tenancies (ASTs) are the default for most residential lettings in England, there are specific circumstances in which a tenancy cannot be classified as an AST. In such cases, landlords must use a Contractual Tenancy Agreement, which falls outside of the Housing Act 1988 regime.

Typical exclusions from AST status include:

High-rent properties (over £100,000 annual rent)

Second homes or part-time residences (not the tenant’s only or principal home)

Lettings by resident landlords (where the landlord shares the premises)

Company tenants or other non-natural persons (covered in our Company Lets folder)

These Contractual Tenancies are not governed by statutory security of tenure protections, making it easier for landlords to regain possession. However, landlords must still comply with the Protection from Eviction Act 1977, which requires at least four weeks’ notice for termination.

Importantly, if a tenant’s circumstances change (e.g. they make the rental their principal home), a contractual tenancy can automatically convert into an AST. That’s why these templates include optional provisions normally found in ASTs, such as tenancy deposit protection clauses, forfeiture clauses, and grounds for possession under the Housing Act 1988.

This folder includes agreements for furnished and unfurnished houses and flats, as well as guarantee agreements for both individual and corporate guarantors. All documents are:

Drafted in plain English

Fully customisable in Word format

Designed to reduce the risk of legal disputes

Supported by our Pre-Tenancy Compliance Checklist and other practical landlord tools

📌 Note: These templates apply to England only. In Wales, tenancies are governed by the Renting Homes (Wales) Act 2016, and ASTs are replaced with standard occupation contracts. See our Renting Homes Wales folder for appropriate documentation.

✅ Documents Included:
Contractual Tenancy Agreement – Furnished House

Contractual Tenancy Agreement – Furnished Flat

Contractual Tenancy Agreement – Unfurnished House

Formalising tenancies with these Contractual Tenancy Agreements ensures landlords retain control over their property while meeting essential legal requirements. Use this document set when standard AST templates don’t apply—but clear, professional terms still matter.
